White Nimbus TCG – Terms of Service

Welcome to White Nimbus TCG, operated by MBC Investments LLC. By accessing our website and purchasing our products, you agree to be bound by the following terms and conditions.

1. RIGHT TO CANCEL & PRICING ERRORS

We reserve the right to refuse or cancel any order at any time. The TCG market is highly volatile; in the event that a product is listed at an incorrect price due to a typographical or system error, White Nimbus TCG shall have the right to cancel any orders placed for the product listed at the incorrect price, even if the order has been confirmed and your payment processed. If your payment has already been processed, we will issue a full refund immediately.

2. PRODUCT LIMITS & BOT PREVENTION

To ensure fair access for all collectors in the community:

  • We reserve the right to limit the quantity of items purchased per person, per household, or per order.

  • These restrictions may include orders placed by the same account, the same credit card, and/or orders that use the same billing/shipping address.

  • We reserve the right to cancel orders that appear, in our sole judgment, to be placed by dealers, resellers, or automated "bot" software.

3. JAPANESE IMPORT DISCLOSURE

White Nimbus TCG specializes in Japanese imports. By purchasing, you acknowledge that:

  • Japanese products are manufactured to different packaging standards than Western releases.

  • Minor cosmetic wear on the outer box (shelf wear, small dings, or "breather holes" in shrink wrap) is a normal result of international transit and does not constitute a "damaged" product under our Refund Policy.

4. PRE-ORDER POLICY

Pre-orders are charged at the time of purchase to secure your inventory.

  • Release Dates: All release dates are estimates provided by manufacturers and are subject to change.

  • Allocations: In the rare event that a manufacturer or distributor "cuts" our allocation (supplies us with less than we ordered), we will fulfill orders in the sequence they were received. Any unfulfilled orders will be refunded in full.

5. LIMITATION OF LIABILITY

To the fullest extent permitted by New Jersey law:

  • White Nimbus TCG (MBC Investments LLC) shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our products or the inability to use our website.

  • Our total liability to you for any claim arising from a purchase shall not exceed the amount paid for the specific product in question.

6. GOVERNING LAW (NEW JERSEY)

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles. Any legal action or proceeding related to your access to, or use of, the Site shall be instituted in a state or federal court in New Jersey.

7. SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.
